Senate Committee Releases Draft Crypto Market Structure Bill

The US Senate Agriculture Committee has published its long-awaited discussion draft of legislation concerning crypto market structure. This development signifies a substantial step forward for Congress in its efforts to establish a clear regulatory framework for the burgeoning cryptocurrency sector. Republican Agriculture Committee Chair John Boozman and Democrat Senator Cory Booker jointly released the draft on Monday. Notably, the document includes bracketed sections, indicating areas where lawmakers are still actively engaged in negotiations.

A central objective of the bill is to delineate the regulatory authority of both the Commodity Futures Trading Commission (CFTC) and the Securities and Exchange Commission (SEC) concerning digital assets. While Congress retains the ultimate authority to define these agencies' regulatory boundaries, both the CFTC and SEC have provided guidance to companies operating in the crypto space, particularly during the previous administration's push for deregulation.

Boozman stated, "The CFTC is the appropriate agency to regulate spot digital commodity trading, and it is essential to establish clear rules for the emerging crypto market while also protecting consumers." His sentiment underscores the perceived need for a specialized regulatory body to oversee the intricacies of digital commodity markets.

Booker added that the discussion draft "would provide the CFTC with new authority to regulate the digital commodity spot market, create new protections for retail customers, and ensure the agency has the personnel and resources necessary to oversee this growing market." This highlights the intention to bolster consumer protection and provide adequate resources for regulatory oversight.

In July, the House of Representatives passed a similar bill, known as the CLARITY Act, and sent it to the Senate. This bill also prioritizes the CFTC's role in regulating the crypto market, suggesting a bipartisan consensus on the need for CFTC involvement.
